1.Broker Relationship

Cars2Go (operated by Cars2go LLC, MC-01813480, USDOT 4562182) is a licensed property broker registered with the Federal Motor Carrier Safety Administration (FMCSA). Cars2Go arranges transportation of motor vehicles through licensed, insured carriers. Cars2Go is not a carrier and does not physically transport vehicles.

2.Service Description

Cars2Go provides an online platform for customers to obtain instant quotes and book auto transport services. When you book a shipment, Cars2Go will arrange for a licensed carrier to transport your vehicle from the origin to the destination specified in your booking.

3.Booking and Payment

By booking a shipment, you authorize Cars2Go to charge your saved payment method when a carrier is dispatched. You will not be charged at the time of booking. A hold or pre-authorization may appear on your account. If you cancel before carrier dispatch, no charge will be processed. Cancellation after dispatch may result in a cancellation fee.

4.Cancellation Policy

You may cancel your shipment free of charge any time before a carrier is dispatched. To cancel, contact Cars2Go support. Once a carrier has been assigned and dispatched, cancellation fees may apply as specified at time of booking.

5.Pricing

Quoted prices are estimates based on lane data and market conditions at time of quote. Actual pricing is confirmed at booking. Prices may vary for inoperable vehicles, oversized vehicles, or non-standard conditions not disclosed at time of quote.

6.Vehicle Condition

Customer represents that all information provided about the vehicle (make, model, year, operability) is accurate. Inoperable vehicles must be disclosed. Additional charges may apply for inoperable vehicles requiring special equipment.

7.Personal Items

Cars2Go recommends against leaving personal items in vehicles during transport. Cars2Go and its carrier partners are not responsible for personal belongings left in vehicles.

8.Insurance

All carriers in the Cars2Go network are required to carry cargo insurance meeting FMCSA minimums. The carrier's insurance covers your vehicle during transport. Cars2Go recommends reviewing your personal auto insurance policy for supplemental coverage.

9.Limitation of Liability

Cars2Go is a licensed property broker. We arrange transportation; we do not operate trucks and we do not take custody of your vehicle. The motor carrier that accepts your shipment is the party responsible for the vehicle while it is in transit, and cargo claims are made against that carrier and its insurance, as described in Section 8. Our own liability to you is limited to the amount of the brokerage fee you paid us for the shipment giving rise to the claim. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of use, loss of income, rental car costs, or delay, even if we were advised such damages were possible. Nothing in this section limits liability that cannot be limited by law, including liability for our own gross negligence, fraud or wilful misconduct, and nothing here limits any right you have against the carrier. Delivery dates and transit times are estimates based on lane data and are not guaranteed.

10.Dispute Resolution

If something goes wrong, contact us first at support@cars2godelivers.com. Most issues are resolved directly, and we ask that you give us 30 days to try before starting a formal proceeding. Cargo damage and loss claims should be filed against the assigned carrier under Section 8; we will provide the carrier details, the bill of lading and the inspection photographs to support your claim. If a dispute between you and Cars2Go cannot be resolved informally, it may be brought in the courts identified in Section 11, or in small claims court where the claim qualifies. Either party may seek injunctive relief for misuse of intellectual property in any court of competent jurisdiction. This section does not apply to any claim you may have against a motor carrier, which is governed by that carrier's own terms and by federal law.

11.Governing Law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules, except where federal transportation law applies — including the Carmack Amendment (49 U.S.C. 14706) and the FMCSA broker regulations at 49 CFR Part 371, which govern interstate motor carriage and brokerage and take precedence where they conflict. The state and federal courts located in Livingston County, Michigan have jurisdiction over disputes between you and Cars2Go, and both parties consent to venue there. If any provision of these terms is held unenforceable, the rest remain in force. Nothing in these terms deprives a consumer of the protection of mandatory provisions of the law of the state in which they reside.
